A witness from the LP, Lawrence Uchechukwu Nnanna Nwakaeti, testified that the District Court of Illinois documents, certifying Tinubu's fine of $460,000, were duly certified by the Sheriffs in the USA. However, during cross-examination by the APC counsel, Nwakaeti admitted that he did not obtain a certificate from the US containing Tinubu's fingerprints and the charges against him. When questioned by Tinubu's lead counsel, Nwakaeti maintained that the judgment specifically fined the president $460,000.

Another witness, Jibrin Okutepa (SAN), led the evidence provided by Atiku, who presented four categories of documents against Tinubu. These documents include copies of the final results declaration and result sheets of the EC8A, EC8D, and EC8E series, BVAS printout reports from the 36 states, and data on registered voters and PVCs collected.

This development marks a significant phase in the ongoing trial, as the court weighs the evidence presented by the petitioners against President Tinubu's victory in the presidential election. Abubakar Achimugu, an aggrieved governorship aspirant in Kogi State, has filed a lawsuit before the Federal High Court in Abuja, seeking the disqualification of Ahmed Usman Ododo, the candidate of the All Progressives Congress (APC) in the state. In the suit marked FHC/ABJ/CS/854/2023, Achimugu alleges that Ododo violated various provisions, including Section 182 of the Nigerian Constitution, Section 84 of the Electoral Act 2022, and Article 7 of the APC's Constitution, by participating in the APC's governorship primary held on April 14.

Achimugu further argues that Ododo, by failing to resign from his employment with the Kogi State public service before contesting and winning the governorship primary, is not qualified to represent the APC in the governorship election scheduled for November 11, 2023.

The lawsuit, filed by Achimugu's lawyer, Josiah Daniel-Ebune, contends that Ododo's failure to resign within the required 30-day period before the primary renders him ineligible to participate in the upcoming governorship poll. The newly constituted tribunal consists of a chairman and four members who will oversee the adjudication of offences committed or allegedly committed under the Act. This independent specialized judicial body aims to uphold equity, openness, fairness, and impartiality in resolving disputes and addressing offences in the advertising industry.

According to Section 38 of the Act, the Minister of Information and Culture, Alhaji Lai Mohammed, appointed Justice Cecilia Olatoregun (rtd) as the chairman of the Advertising Offences Tribunal. Justice Olatoregun served as a Judge of the Federal High Court from July 2000 to November 2019 and previously held the position of Chief Registrar and Admiralty Marshal of the Federal High Court from November 1998 to July 2000. With her extensive experience, including overseeing multiple divisions of the Federal High Court, Justice Olatoregun is well-equipped to lead the tribunal.

The announcement was made by the state Commissioner of Local Government, Hajiya Umma Ahmad, in a statement on Monday.

According to the statement, both traditional rulers have been removed from their positions effective immediately. Babangida Sule, the District Head of Garun Kurama, will temporarily oversee the affairs of Piriga Chiefdom until a new chief is appointed. Similarly, Gomna Ahmadu, the Council Secretary of Arak Chiefdom, will oversee the affairs of the chiefdom and initiate the process for the appointment of a new chief.

The decision to depose the monarchs was based on various reasons. General Iliyah Yammah was deposed due to his appointment of four district heads, which was in violation of the approved number for his chiefdom, as well as his non-residence within the Arak chiefdom. Jonathan Zamuna's deposition was a result of communal clashes between the Gure and Kitimi communities in Piriga Chiefdom and his non-residence within the chiefdom.

In addition, the statement also announced the immediate disengagement of the village heads of Aban, Abujan Mada, and Anjil in Arak Chiefdom.

The President's spokesman, Mr Femi Adesina, confirmed the development in a statement, highlighting that the projects include three major bridges, three federal secretariats, and a road. The headline project is the long-awaited Second Niger Bridge, which was conceived in 2005.

Among the projects to be inaugurated is the Loko-Oweto Bridge, which spans the River Benue and connects Benue to Nasarawa. Additionally, the Ikom Bridge in Cross River and a completed section of the Kano-Kaduna Dual Carriage Expressway will be unveiled.

The three new federal secretariats are also part of the projects. The first one, located in Awka, Anambra State, was awarded in 2011 and completed in July 2022. It features 498 office spaces, conference halls, committee rooms, exhibition halls, banking facilities, and other amenities.

The funds were claimed to have been used for the purchase of vehicles, computer accessories, photocopying, production, and airing of a special video documentary. However, these expenses were found to be related to fictitious contracts, as revealed in the 2018 report of the Auditor General for the Federation (AuGF).

The Senate Public Accounts Committee (SPAC), chaired by Senator Matthew Urhoghide, thoroughly scrutinized the AuGF report and subsequently submitted their findings to the Senate leadership. The SPAC report was deliberated upon during a plenary session, and the red chamber unanimously upheld the recommendations put forth by the Urhoghide-led panel.

According to the committee's investigation, it was discovered that a contract worth N343 million had been awarded for the purchase of project monitoring vehicles without following due process. Shockingly, it was revealed that these vehicles were never actually supplied.

The panel further unearthed another contract, which involved the provision of services and direct purchase of vehicle spare parts, computer accessories, and photocopying machine parts. This contract, valued at an amount not disclosed in the report, was found to have also bypassed proper procurement procedures.

Additionally, the committee shed light on a contract for the designing of Nigerian roads and bridges, amounting to N139 million. It was determined that this particular contract failed to adhere to due process requirements.

Furthermore, the investigation revealed that N210 million allocated for a documentary project was improperly divided into N130 million and N80 million. These funds were deposited into a staff account, a clear violation of the Financial Regulation. Notably, the examination discovered that the N130 million was allocated to various developmental projects across different ministries, such as Finance, Agriculture, Transport, Petroleum Resources, Mines and Steel, and Trade and Investment. Disturbingly, there was a lack of receipts or retirement records attached to the payment vouchers, failing to substantiate the legitimacy of these payments.

Despite extending numerous invitations to the Ministry of Works to defend the allegations raised by the Auditor General of the Federation, the officials consistently ignored these invitations. Consequently, the committee was left with no choice but to maintain the position put forth by the AuGF.

The Senate's decision to direct the Ministry of Works to refund the N692 million is an important step towards combating corruption and ensuring accountability within the government. It remains to be seen how the Ministry will respond to this directive and how the government will take further action to address such fraudulent practices.

The distributed revenue consists of N364.654 billion from distributable statutory revenue, N202.762 billion from distributable Value Added Tax (VAT) revenue, N14.516 billion from Electronic Money Transfer Levy (EMTL), N50 billion augmentation from Forex Equalisation revenue, and N24 billion augmentation from Non-mineral revenue.

The federal government received N248.809 billion, the states received N218.307 billion, and the local governments were allocated N160.600 billion.

Additionally, the oil-producing states received N28.216 billion as 13 percent mineral revenue based on the Derivation Principle.

Statements from the Ministry of Finance, Budget, and National Planning, as well as the Office of the Accountant General of the Federation (OAGF), cited a communique issued after the FAAC meeting in Abuja.

According to the statement, the Gross Revenue available from VAT for April 2023 was N217.743 billion, showing a decrease compared to the previous month of March. From this amount, N8.710 billion was allocated for costs of collection, and N6.271 billion was allocated for transfers and refunds. The remaining N202.762 billion was distributed to the federal, state, and local governments, with the federal government receiving N30.414 billion, the states receiving N101.381 billion, and the local governments receiving N70.967 billion.

Regarding the Gross Statutory Revenue, N497.463 billion was received for April, which was lower than the N638.673 billion received in March 2023. From this amount, N18.793 billion was allocated for costs of collection, and N114.016 billion was allocated for transfers and refunds. The remaining N364.654 billion was distributed, with the federal government receiving N180.659 billion, the states receiving N91.632 billion, the local governments receiving N70.647 billion, and N21.716 billion allocated for 13 percent oil derivation.

Furthermore, N15.121 billion from Electronic EMTL was also distributed, with the federal government receiving N2.177 billion, states receiving N7.258 billion, and local councils receiving N5.081 billion. Additionally, N0.605 billion was allocated for costs of collection.

An augmentation of N50 billion from Forex Equalization was also included in the allocation, with N22.916 billion for the federal government, N11.623 billion for the states, N8.961 billion for local councils, and N6.500 billion for 13 percent mineral revenue.

The statements mentioned that Petroleum Profit Tax (PPT), Companies Income Tax (CIT), Oil and Gas Royalties, Import and Excise Duties, and VAT experienced significant decreases during the reference month. However, EMTL showed a marginal increase.

As of May 18, 2023, the Excess Crude Account (ECA) balance stands at $473,754.57.

The allocation by FAAC provides financial support to the various tiers of government, enabling them to carry out developmental projects and meet their respective obligations.

Yesterday, Obi’s lawyer, Livy Uzoukwu, a Senior Advocate of Nigeria (SAN), informed the five-member panel of the court led by Haruna Tsammani that INEC “stubbornly refused to produce 70 per cent of the electoral documents that were requested by LP.”

Specifically, Uzoukwu said electoral documents concerning the polls in Rivers and Sokoto states have been inaccessible from INEC. “A typical example is that of Rivers, where the INEC Resident Electoral Commissioner boldly told us they do not have any form EC8 to give us,” Uzoukwu said.

The lawyer recalled two previous rulings of the court, directing INEC to grant access to the Labour Party for the inspection of electoral documents like the Bimodal Voters Accreditation System (BVAS) machines that were deployed for the conduct of the presidential poll.

But INEC’s lawyer, Abubakar Mahmoud (SAN), expressed the electoral umpire’s readiness to cooperate with all parties in the petitions and the court. He said Obi’s legal team declined to attend a meeting that was called to streamline issues around documents to be tendered before the court.

After listening to all parties in the petition, the court adjourned proceedings until May 19. MEANWHILE, there was commotion yesterday at the resumed sitting of the Presidential Election Petition Court (PEPC) sitting at the Court of Appeal in Abuja when the acclaimed National Chairman of LP, Lamidi Apapa, was mobbed by factional members of the party loyal to Obi, at the court premises. It took the efforts of about 50 policemen before Apapa could be rescued from being lynched by the factional members who conducted themselves in unruly manners. Apapa, who was dressed in white agbada to the court, was jerked several times by the attackers and was immediately taken to custody by the police upon his rescue.

The factional members believed to be loyal to the suspended National Chairman of the party, Julius Abure, held their victim hostage for almost one hour while attempting to come out of the court after the day’s proceedings to address newsmen who were on standby to get his reaction to the leadership dispute in the party. Apapa said he was nearly killed by the mob while he was leaving the Court of Appeal, Abuja, after the PEPC adjourned pre-hearing in Obi’s petition. At the resumed session, Apapa had attempted to occupy the seat reserved for Abure — the national chairman recognised by Obi’s faction — but was resisted by party chieftains.

Blinken added, “We do not yet know the motive for the attack, but we have no indications at this time that it was targeted against our Mission. The assailants killed at least four members of the convoy, and U.S. Mission personnel are working urgently with Nigerian counterparts to ascertain the location and condition of the members of the convoy who are unaccounted for. We condemn in the strongest terms this attack. We will work closely with our Nigerian law enforcement colleagues in seeking to bring those responsible to justice."

It said the renovation work would not be completed before the inauguration of the 10th Assembly in June.

Executive Secretary, FCDA, Shehu Hadi Ahmad, who addressed a press conference in Abuja yesterday, said the building would be ready for use by August.

The lawmakers have been using makeshift chambers since the commencement of the renovation work in April 2022.

Ahmad explained that the enormity of work required for a world class parliament building needed not to be rushed to avoid past mistakes.

According to him, the comfort and convenience of parliamentarians in the two chambers is of paramount importance for smooth legislative and budgetary duties.

Daily Trust Newspaper18 May 2023Delta Assembly passes N71bn supplementary budgetDelta State House of Assembly, yesterday, passed a supplementary appropriation bill of N71 billion for the 2023 fiscal year ending December 31.

Governor Ifeanyi Okowa had on Tuesday, forwarded a letter containing the supplementary budget proposal to the House Assembly for necessary legislative actions. Governor Okowa had in the letter, explained that the proposed appropriation bill was made up of N5.6 billion for recurrent expenditure, and N65.5 billion for capital expenditure for the year ending December 3, 2023.

The appropriation bill, which went through first reading on Tuesday, was read the second and third time and, subsequently, passed. Opening debate on the bill after the suspension of relevant rules of the House, Majority Leader of the House, Ferguson Onwo, commended Governor Okowa for the proposed bill, noting that the bill was aimed at ensuring the completion of ongoing developmental projects in the state.

The lawmakers who spoke separately on the importance of the bill at the plenary chaired by the Deputy Speaker of the state Assembly, Ochor Ochor, insisted that the passage of the bill would help in scaling up the infrastructural and capital developments in the state.

The first bill, No. 58, aims to allow independent candidacy in various elections, including presidential, governorship, and local government councils. The second bill, No. 46, seeks to include the presiding officers of the National Assembly in the membership of the National Security Council. These bills were part of the constitution alteration bills that were sent to state Houses of Assembly for concurrence last year but did not secure the necessary approval from 24 out of 36 state assemblies.

Deputy Senate President, Ovie Omo-Agege, who is also the Chairman of the Senate Ad hoc Committee on Constitution Review, informed his colleagues during the plenary session that the Gombe State House of Assembly has approved both bills. With this approval, the bills have met the requirements outlined in section 9(2) of the constitution for passage. Following the adoption of Omo-Agege's motion, the Senate instructed the Clerk to transmit the bills to the president for his assent.

It is worth noting that out of the 35 constitution alteration bills previously transmitted to the president for assent, 19 were rejected and 16 were signed into law. Furthermore, five state assemblies - Jigawa, Kebbi, Kwara, Plateau, and Taraba - are yet to forward their resolutions on the constitution amendment bills.

The proposed legislation also grants the Independent National Electoral Commission (INEC) the authority to determine the administrative fees to be paid by independent candidates for respective elections. Moreover, it mandates INEC to waive fifty percent of the administrative fees for women candidates, aiming to promote gender inclusivity in politics.

Within this budget, provisions totaling N451 million were allocated for the aides of 12 NDDC board members.

Additionally, the budget includes N576 million specifically designated for the operation of the Chairman's Office, held by Laurreta Onochie. The breakdown of the Chairman's Office budget reveals N156 million for personnel costs, N312 million for overhead costs, and N108 million for internal capital.

The Managing Director's Office received N546.597 million for personnel costs, N747.500 million for overhead costs, and N163.504 million for internal capital.

Other budget allocations include N133.337 million for personnel costs, N457.465 million for overhead costs, and N163.504 million for internal capital in the Executive Director Finance & Administration Office.

The Corporate Affairs Department of the Commission was granted N1.061 billion, with N431.076 million allocated for personnel costs, N845.566 million for overhead costs, and N63.081 million for Internal Audit.

Overall, the commission's budget allocates N34.2 billion for personnel expenditure, N17 billion for overhead expenditure, N3.7 billion for internal capital expenditure, N490 billion for development projects, and N330 billion for the federal government's intervention in the Niger Delta.

To finance the budget, various revenue sources have been identified, including N5 billion from revenue brought forward, N119 billion from the federal government's contribution, N430 billion from unpaid areas of the federal government's contribution, N297 billion from oil companies' contributions, N20 billion from ecological funds, and N500 million from other internally realized income.

According to the investigation, Peter Obi of the Labour Party (LP) actually won the election in Rivers State, contradicting claims by Rivers State Governor, Nyesom Wike, that he worked for the victory of Bola Tinubu, the presidential candidate of the All Progressives Congress (APC).

The BBC analyzed polling station results sheets, which were published online by the electoral commission for the first time in a Nigerian election. After comparing the polling station sheets with the results declared at the state level, the BBC found significant discrepancies. The official result gave a clear majority to Tinubu, but the BBC's tally indicated that Obi had received the majority of votes in the state by a wide margin.

The investigation also highlighted challenges in obtaining complete and accurate results. Some polling station results were incorrectly uploaded or missing, while others were too blurred to read. The BBC estimated that around 5 percent of polling stations had missing or unreadable results. Additionally, security issues, technical problems, and non-arrival of voting materials resulted in no voting taking place at some polling stations.

The report identified two areas with the biggest discrepancies: Oyigbo local government area and Obio/Akpor. In Oyigbo, the vote for Tinubu was six times larger in the officially announced results compared to the BBC's polling station count, while Obi's votes were significantly reduced. Similarly, in Obio/Akpor, the official result for Tinubu was much higher than the polling station tally, while Obi's votes were underreported.

The investigation also raised concerns about the identity of an election official named Dr. Dickson Ariaga in Oyigbo. The BBC discovered that there was no record of him working at the Federal College of Education in Omoku, as he claimed. Nigeria's Independent National Electoral Commission (INEC) acknowledged a shortage of time and personnel during the election and admitted to taking on some individuals without proper verification.

When approached for a response, INEC's regional spokesperson in Port Harcourt acknowledged the discrepancies but stated that ongoing legal challenges prevented them from commenting further. The BBC concluded that this case in Rivers state indicates manipulation of results and highlights the need for further scrutiny in other areas of Nigeria.

The court ruling by Justice Inyang Ekwo states that the NYSC should cease publishing disclaimers asserting that the NYSC certificate issued to Barrister Mbah Peter Ndubuisi on June 6, 2003, was not issued by the corps, pending the hearing and determination of the motion on notice for an interlocutory injunction.

Mbah's lawyer, Emeka Ozoani (SAN), filed an application requesting the court to address the substantive issues of law and facts, which present reasonable cause of action against the NYSC and the Director of Corps Certification, Ibrahim Muhammad. Mbah, who graduated from the University of East London in 2000, completed his Bar Part 1 examination and was awaiting the Bar Part 2 program. Advised not to waste time, he decided to undertake the mandatory one-year NYSC program. After six months of national service, he was further advised to resume law school when the Bar Part 2 program commenced, with the approval of the NYSC. Subsequently, he completed his service in 2003 and received his certificate.

The case has been adjourned to May 22 for further proceedings.

The disclosure was made by INEC National Commissioner and Chairman of its Information and Voter Education Committee, Mr. Festus Okoye, in a statement released yesterday in Abuja.
According to the statement, all political parties conducted their primaries as required by law and uploaded the names and personal particulars of their candidates and running mates to the INEC candidate nomination portal by the deadline of 6 p.m. on May 5, 2023. Furthermore, all 18 political parties have nominated candidates for the Kogi governorship election, while 17 parties have nominated candidates for the Bayelsa and Imo states' elections. As required by Section 29 (3) of the Electoral Act 2022, INEC will publish the personal particulars of the candidates in the state headquarters and local government offices in the three states on May 12, 2023. The statement urged Nigerians to scrutinise the list and report any aspirant who participated in their party’s primaries with reasonable grounds to believe that the information provided by the candidate is false. The committee was setup follwoing a proposal made by Senator Adamu Aliero (PDP, Kebbi) during discussion of a report by the Committee on Niger Delta on the budgets for the NDDC in 2021, 2022, and 2023.

Earlier this year, President Muhammadu Buhari requested that the Senate pass the NDDC budgets for 2021, 2022, and 2023. The agency had already spent N 1.4 billion of the money for the fiscal years 2021 and 2022, when the request for approval was made.

According to Buhari's request forwarded to the legislature, the NDDC will receive a total budget of N485.7 billion in 2021, N928.2 billion in 2022, and N876 billion in 2023. After scaling second reading, the Senate submitted the budgets to its Committee on Niger Delta.

The Committee on Niger Delta, led by Senator Bulus Amos (APC, Gombe), asked the Senate to accept the budget estimates in its report. However, Senator Aliero criticized the committee's suggestion, claiming it was against the law for the NDDC to use the budget projections without the National Assembly's consent.

Senators Seriake Dickson (PDP, Bayelsa) and Solomon Adeola (APC, Lagos) were among the other Senators who voiced their concerns on the consideration of the budgets. Adeola argued that it was important to thoroughly review the NDDC estimates since additional information and explanations were needed about some budgetary items. Consequently, Senate President Ahmad Lawan constituted a an adhoc committee to look into the financial operations of NDDC on the projected budgets for 2021 and 2022.

Justice Haruna Tsammani, the tribunal's presiding justice, scheduled the hearing of the parties' answers to pre-hearing questions on Obi and LP's plea on Monday.

The tribunal will evaluate whether parties complied with its order to condense the points they would raise in the main hearing during the session, which has been scheduled for 2pm.

Also, the tribunal has set May 11 as the date for hearing Bola Tinubu, the APC candidate and president-elect, challenging petitioner Atiku's two motions.

Atiku's petition has several paragraphs where he raises new problems that, according to Tinubu, were not stated in the original petition while responding to his preliminary objection. In the first motion filed by his attorney, Lateef Fagbemi (SAN), Tinubu is attempting to have these paragraphs removed.

Due to the forfeiture of $460,000 to the United States by Tinubu, Atiku claimed Tinubu did not meet the constitutional threshold and is ineligible to run for president of the Federal Republic of Nigeria. Additionally, Tinubu was accused by Atiku of failing to mention in his Form EC9 that he has dual citizenship with the Republic of Guinea and the Federal Republic of Nigeria after voluntarily obtaining that citizenship.

In the ruling, Justice James Omotosho also overturned the N500,000 fines levied on each of the 45 broadcast stations on March 1, 2019.

According to Justice Omotosho, the NBC lacked the authority to punish broadcast stations because it was not a court of law. He further asserted that Section 6 of the Constitution, which gave courts of law the exclusive right to exercise judicial authority, conflicts with the NBC Code, which grants the commission the authority to issue sanctions.

He further declared that the court would not do nothing while a body arbitrarily imposed a fine without following the law. He said that the commission broke the law by appearing before the court and the judge on its own case while also acting as a complainant.

The judge concluded that the Nigeria Broadcasting Code cannot grant the commission judicial authority to impose criminal sanctions or penalties, such as fines, because it is a subsidiary law that enables an administrative body, such as the NBC, to implement its requirements.

He also concurred that the commission lacked the authority to launch a criminal inquiry that would result in a criminal prosecution and the application of sanctions because it was not the Nigerian police. The notion of separation of powers will be violated, he said.

According to Omotosho, the goal of the ideology was to stop tyranny by not putting too many powers in one place. "The respondent's action qualifies as excessive" since it granted itself judicial and executive authority.

""As elders, we will continue to advise them to do the right thing. We tried not to intervene in the issue of bringing or removing any emir, but now, an opportunity has come. "Besides the emir, even the emirate has been divided into five places. All these need to be studied. Usually, a leader inherits good and bad issues that are hard to reconcile,"" Kwankwaso said.

Following the rejection of the consensus agreement by roughly 68 senators-elect from various political parties, a meeting was scheduled. The senators-elect held a meeting in Abuja from Saturday night till early Sunday morning. They decided to reject any compromise option that may force presiding officers on the upper chamber of the 10th National Assembly, which is scheduled to be inaugurated on June 13. The All Progressives Congress (APC) Integrity Group, an organization that supports the ruling party, issued a warning to Bola Tinubu and the APC's National Working Committee not to cause a party crisis over the zoning of leadership positions in the federal assembly.
In a related development, the caucus of senators-elect from the South-east yesterday approved a motion opposing the zoning of the Senate President to the South-South geopolitical zone. They advised Tinubu to refrain from promoting and aiding ""injustice"".
The Arewa Consultative Forum (ACF) also distanced itself from the reported support of Senator Godswill Akpabio, a former minister of Niger Delta affairs, for the position of senate president by a confederation of northern groupings.

According to a press release provided to journalists, the Tribunal was scheduled to hold its first meeting at Moore Road, the location for the Tribunal. However, when Daily Sun visited the location on Wednesday morning, the entire Court Complex within the Moore Road axis was blocked, and the secretary of the Panel, Akawu Bambur, was refused entry.
